Appeals court sides with tribes in fight over land decisions

In a victory for Native American tribes, an appeals court ruled Thursday that states cannot use negotiations for a Native American casino to challenge the federal government's decisions to recognize a tribe and set aside land for it.
An 11-judge panel of the 9th U.S. Circuit Court of Appeals said states have to use a separate process to contest those decisions and have a window of six years to file their challenge.
The decision removes the uncertainty many tribes faced about their land status after a smaller 9th Circuit panel reached a different conclusion, said Joe Webster, a partner with the Washington, D.C.-based law firm of Hobbs Straus Dean & Walker who was closely watching the case.
"This is certainly an important decision for tribes," he said.
The ruling came in a fight between California and the Humboldt County-based Big Lagoon Rancheria over the tribe's plan for a Las Vegas-style casino.
The tribe accused the state in a lawsuit of failing to negotiate a casino deal in good faith, and largely won its case in federal district court. A call to the state attorney general's office for comment about Thursday's ruling wasn't immediately returned.

High court won't hear appeal over Walker campaign probe

The Supreme Court won't hear an appeal from a conservative group seeking to end an investigation into possible illegal coordination between Wisconsin Gov. Scott Walker's 2012 recall campaign and independent groups.
The justices on Monday let stand an appeals court ruling that said Wisconsin Club for Growth and its director, Eric O'Keefe, must resolve their claims in state courts.
No one has been charged as a result of the investigation which has sought documents and testimony about possible violation of state campaign finance laws.
The investigation is on hold while a separate legal challenge is pending before the Wisconsin Supreme Court.
The club and O'Keefe argued that the investigation was a violation of their First Amendment rights and an attempt to criminalize political speech.

New Jersey, leagues renew court tussle over sports gambling

The fight over legalized sports gambling in New Jersey returned to a federal appeals court Tuesday, where attorneys for the state and the country's major sports leagues spent nearly an hour parsing language in a decades-old federal statute and in recent court rulings.
At issue: Whether a 2014 New Jersey law repealing prohibitions against sports gambling violates the 1992 federal Professional and Amateur Sports Protection Act, which says states cannot "sponsor, operate, advertise, promote, license or authorize" sports betting.
A good portion of Tuesday's oral arguments before the 3rd U.S. Circuit Court of Appeals focused on the meaning of the word "authorize," and whether New Jersey did that when Gov. Chris Christie signed the law striking the betting prohibitions.
Attorneys from both sides endured sharp questioning from the court, which heard a previous incarnation of the case in 2013. In the ruling that followed that argument, the court said New Jersey couldn't be prevented from repealing its sports gambling laws. The state seized on that language to write its 2014 law. |

Calif. analyst pleads guilty in NY insider case

A California financial analyst has pleaded guilty in New York, admitting he provided insider tips to an SAC Capital portfolio manager.
Sandeep Aggarwal admitted Friday that he provided the tips to the SAC employee and others about a blockbuster deal between Microsoft Corp. and Yahoo Inc. Investigators say the information pertained to a secret, pending search engine advertising partnership between the companies.
Aggarwal has pleaded guilty to conspiracy to commit securities fraud and securities fraud in Manhattan in a cooperation deal. The 40-year-old was arrested in July in San Jose, Calif.
Authorities say they had wiretap evidence from 2009.
Aggarwal told a magistrate judge he provided the tips to boost his standing as an analyst. He says he is "extremely sorry." |

Italian court insists Berlusconi devised tax fraud

Italy's supreme court is defending its decision earlier this month to uphold the tax fraud conviction of Silvio Berlusconi, saying the evidence was clear that the former premier devised a tax fraud scheme for the acquisition of film rights for his media empire.
The Court of Cassation released on Thursday a written document explaining its Aug. 1 decision, which upheld a Milan appellate court ruling that Berlusconi was guilty. The Cassation judges also upheld a four-year prison term and a ban on public office, although it ordered another court to establish the length of the ban.
The center-right leader says he's the victim of magistrates he contends sympathize with the left. His lawyers will be scrutinizing the 208-page document to try to bolster their claims that Berlusconi's rights were violated.
