SC high court blocks ruling during Harrell appeal

South Carolina's high court has blocked a judge's dismissal of an investigation into one of the state's top lawmakers while prosecutors appeal.
The state Supreme Court said Thursday it would block the ruling by Circuit Judge Casey Manning earlier this month.
The new order allows prosecutors to continue their investigation into corruption allegations against House Speaker Bobby Harrell. Manning had said Attorney General Alan Wilson improperly empaneled a State Grand Jury in the case.
Manning said courts cannot consider such a case against a lawmaker until a legislative ethics panel has reviewed it. Harrell's attorneys agree, but Wilson says the ruling infringes on his role as the state's top prosecutor.
Wilson is appealing that decision. Both sides are to make their case before the Supreme Court on June 24. |

Federal court upholds California water transfer

A federal appeals court says environmental reviews were properly done on the nation's largest farm-to-city water transfer, the latest ruling to uphold a 2003 agreement on how California agencies divide that state's share of Colorado River water.
A three- judge panel of the 9th U.S. Circuit Court of Appeals ruled Monday that federal authorities properly considered how the transfer from Imperial County to San Diego would affect the Salton Sea, California's largest lake. The shrinking lake relies on water runoff from Imperial Valley farms.
The ruling upholds a decision by U.S. District Judge Anthony Battaglia in San Diego. Imperial County and the Imperial County Air Pollution Control sued in 2009, alleging violations of the National Environmental Policy Act. |

Arkansas court says judge went too far on voter ID

The Arkansas Supreme Court tossed out a judge's ruling striking down the state's voter ID law on Wednesday, but stopped short of ruling on the constitutionality of the measure.
In a 5-2 ruling, justices vacated a Pulaski County judge's decision that the law violates Arkansas' constitution. Pulaski County Circuit Judge Tim Fox had struck down the law in a case that had focused on how absentee ballots are handled under the law, but justices stayed his ruling while they considered an appeal.
Fox also has ruled the law unconstitutional in a separate case but said he wouldn't block its enforcement during this month's primary. That ruling is being appealed to the high court.
Justices said Fox didn't have the authority to strike down the law in the case focusing on absentee ballots. They noted that there was no request before Fox in the case to strike down the law. |
